Privacy Policy

Clouvou Inc. (“Clouvou,” “we,” “our,” “us”) is committed to protecting your privacy. This Privacy Policy explains how your personal information is collected, used, and disclosed by Clouvou for our United States online store.

This Privacy Policy applies to our United States website and its associated subdomains (collectively, our “Service”) alongside our application, Clouvou. By accessing or using our Service, you signify that you have read, understood, and agree to our collection, storage, use, and disclosure of your personal information as described in this Privacy Policy and our Terms of Service.

If you are located in the European Economic Area, the United Kingdom, or Switzerland, this Policy does not apply to you — please see the Clouvou GmbH Privacy Policy at clouvou.de, which governs our European store.

Definitions and key terms

To help explain things as clearly as possible, every time any of these terms are referenced, they are strictly defined as:

  • Cookie: a small amount of data generated by a website and saved by your web browser, used to identify your browser, provide analytics, or remember information such as your language preference or login information.

  • Company: when this policy mentions “Company,” “we,” “us,” or “our,” it refers to Clouvou Inc., 120 Wall Street, 20th Floor, New York, NY 10005, USA, responsible for your information under this Privacy Policy for our United States store.

  • Country: where Clouvou Inc. is incorporated — in this case, the United States.

  • Customer: the company, organization, or person that signs up to use the Clouvou Service to manage its relationship with its own consumers or service users, where applicable.

  • Device: any internet-connected device, such as a phone, tablet, or computer, that can be used to visit Clouvou and use the Services.

  • IP address: every device connected to the internet is assigned a number known as an Internet Protocol (IP) address; these numbers are usually assigned in geographic blocks and can often be used to identify the location from which a device is connecting.

  • Personnel: individuals employed by Clouvou or under contract to perform a service on Clouvou's behalf.

  • Personal Data: any information that directly, indirectly, or in connection with other information — including a personal identification number — allows for the identification of a natural person.

  • Service: the service provided by Clouvou as described in the relative terms and on this platform.

  • Third-party service: advertisers, promotional and marketing partners, and others who provide content or whose products or services we think may interest you.

  • Website: www.us.clouvou.com

  • You: a person or entity that is registered with Clouvou to use the Services, or a customer of our United States store.

What Information Do We Collect?

We collect information from you when you visit our website, register on our site, place an order, subscribe to our newsletter, respond to a survey, or fill out a form.

  • Name / Username

  • Phone Numbers

  • Email Addresses

  • Mailing Addresses

  • Billing Addresses

  • Debit/credit card numbers — we may collect this through third-party services we use, such as our payment processor(s) (currently PayPal and/or Shopify Payments), as part of completing your purchase.

  • Age

  • Password

We also collect information from mobile devices for a better user experience, although these features are completely optional:

  • Location (GPS): we may collect this through third-party services we use, such as analytics or advertising partners. Where collected, it helps create an accurate representation of your interests and can be used to bring more targeted and relevant ads to potential customers.

When Does Clouvou Use End User Information From Third Parties?

Clouvou will collect End User Data necessary to provide the Clouvou Services to our customers. End users may voluntarily provide us with information they have made available on social media websites. If you provide us with any such information, we may collect publicly available information from the social media websites you have indicated. You can control how much of your information social media websites make public by visiting those websites and changing your privacy settings.

When Does Clouvou Use Customer Information From Third Parties?

We receive some information from third parties when you contact us. For example, when you submit your email address to us to show interest in becoming a Clouvou customer, we receive information from a third party that provides automated fraud-detection services to Clouvou. We also occasionally collect information made publicly available on social media websites. You can control how much of your information social media websites make public by visiting those websites and changing your privacy settings.

Do We Share the Information We Collect With Third Parties?

We may share the information we collect, both personal and non-personal, with third parties such as advertisers, promotional and marketing partners, and others who provide our content or whose products or services we think may interest you. We may also share it with our current and future affiliated companies and business partners, and if we are involved in a merger, asset sale, or other business reorganization, we may also share or transfer your personal and non-personal information to our successors-in-interest.

We engage trusted third-party service providers to perform functions and provide services to us, including hosting and maintaining our servers and website (Shopify), database storage and management, email and SMS marketing (Klaviyo), payment and credit-card processing (PayPal / Shopify Payments), customer service, and fulfilling orders for products you purchase through the website. We will likely share your personal information, and possibly some non-personal information, with these third parties to enable them to perform these services for us and for you.

We may share portions of our log file data, including IP addresses, for analytics purposes with third parties such as web analytics partners, application developers, and ad networks — including Meta (Facebook/Instagram), for advertising and remarketing (see “Facebook Pixel” and “Remarketing Services” below). If your IP address is shared, it may be used to estimate general location and other technographics such as connection speed, whether you have visited the website in a shared location, and the type of device used. They may aggregate information about our advertising and what you see on the website, then provide auditing, research, and reporting for us and our advertisers.

We may also disclose personal and non-personal information about you to government or law enforcement officials or private parties as we, in our sole discretion, believe necessary or appropriate to respond to claims, legal process (including subpoenas), protect our rights and interests or those of a third party, protect the safety of the public or any person, prevent or stop illegal, unethical, or legally actionable activity, or otherwise comply with applicable court orders, laws, rules, and regulations.

Where and When Is Information Collected From Customers and End Users?

Clouvou collects personal information that you submit to us directly. We may also receive personal information about you from third parties, as described above.

How Do We Use the Information We Collect?

Any of the information we collect from you may be used in one of the following ways:

  • To personalize your experience (your information helps us better respond to your individual needs)

  • To improve our website (we continually strive to improve our website offerings based on the information and feedback we receive from you)

  • To improve customer service (your information helps us more effectively respond to your customer-service requests and support needs)

  • To process transactions

  • To administer a contest, promotion, survey, or other site feature

  • To send periodic emails or texts, if you have opted in through our marketing platform, Klaviyo — unsubscribe anytime via the link in any message

  • To detect and prevent fraud, and to secure and operate our website

  • To serve and measure interest-based advertising, including through the Meta Pixel and similar remarketing tools (see “Cookies” below)

How Do We Use Your Email Address?

By submitting your email address on this website, you agree to receive emails from us. You can cancel your participation in any of these email lists at any time by clicking the opt-out link or other unsubscribe option in the respective email. We only send emails to people who have authorized us to contact them, either directly or through a third party — we do not send unsolicited commercial emails.

By submitting your email address, you also agree to allow us to use it for customer-audience targeting on platforms like Meta (Facebook/Instagram), where we may display custom advertising to people who have opted in to receive communications from us. Email addresses submitted only through the order-processing page are used solely to send information and updates about your order, unless you have provided the same email to us through another method. If you would like to unsubscribe from future emails, detailed unsubscribe instructions are included at the bottom of each email.

How Long Do We Keep Your Information?

We keep your information only so long as we need it to provide Clouvou to you and fulfill the purposes described in this policy, and the same is true for anyone we share your information with who carries out services on our behalf. In practice: order and transaction records are retained for as long as needed for accounting, tax, and warranty purposes (generally 7 years); account information is retained until you ask us to delete your account; marketing contact data is retained until you unsubscribe or ask us to delete it. When we no longer need your information and are not required to keep it to comply with a legal or regulatory obligation, we will remove it from our systems or depersonalize it so that we can't identify you.

How Do We Protect Your Information?

We implement a variety of security measures to maintain the safety of your personal information when you place an order or enter, submit, or access your personal information. We offer the use of a secure server. All supplied sensitive information is transmitted via Secure Socket Layer (SSL) technology. As noted above, we do not ourselves store full payment card numbers — that data is transmitted directly to, and encrypted within, our payment processor's own database, accessible only to those authorized parties required to keep it confidential. We cannot, however, ensure or warrant the absolute security of any information you transmit to Clouvou, or guarantee that information on the Service may not be accessed, disclosed, altered, or destroyed by a breach of any of our physical, technical, or managerial safeguards.

Could My Information Be Transferred to Other Countries?

Clouvou Inc. is incorporated in the United States. Information collected via our website, through direct interactions with you, or from use of our services may be transferred from time to time to our offices or personnel, or to third parties, located in other countries, and may be viewed and hosted wherever those parties operate, including countries that may not have data protection laws of general applicability. By using our Service, you consent to this transfer and hosting of information as described.

Where any such transfer involves personal information originating in the European Economic Area, the United Kingdom, or Switzerland (for example, limited data shared with our German affiliate, Clouvou GmbH, for shared corporate functions), that specific transfer is made under the EU–U.S. Data Privacy Framework or another legally recognized transfer mechanism, rather than on consent alone.

Is the Information Collected Through the Clouvou Service Secure?

We take precautions to protect the security of your information. We have physical, electronic, and managerial procedures in place to help safeguard against unauthorized access, maintain data security, and correctly use your information. However, neither people nor security systems are foolproof, including encryption systems, and people can commit intentional crimes, make mistakes, or fail to follow policies. Therefore, while we use reasonable efforts to protect your personal information, we cannot guarantee its absolute security. If applicable law imposes a non-disclaimable duty to protect your personal information, you agree that intentional misconduct will be the standard used to measure our compliance with that duty.

Can I Update or Correct My Information?

You can contact us in order to (1) update or correct your personal information, (2) change your preferences with respect to communications and other information you receive from us, or (3) delete the personal information maintained about you on our systems (subject to the following), by contacting us using the details below. Such updates, corrections, changes, and deletions will have no effect on other information we maintain, or information we have already provided to third parties in accordance with this Privacy Policy prior to the update, correction, change, or deletion. To protect your privacy and security, we may take reasonable steps (such as requesting a unique password) to verify your identity before granting access or making corrections.

It is not always technologically possible to remove every record of information you have provided to us. The need to back up our systems to protect information from inadvertent loss means a copy of your information may exist in a non-erasable form that is difficult or impossible for us to locate. Promptly after receiving your request, all personal information stored in databases we actively use, and other readily searchable media, will be updated, corrected, changed, or deleted, as appropriate, as soon as and to the extent reasonably and technically practicable.

Personnel

If you are a Clouvou worker or job applicant, we collect information you voluntarily provide to us and use it for Human Resources purposes, including to administer benefits to workers and screen applicants. You may contact us to (1) update or correct your information, (2) change your preferences with respect to communications you receive from us, or (3) receive a record of the information we hold relating to you.

Sale of Business

We reserve the right to transfer information to a third party in the event of a sale, merger, or other transfer of all or substantially all of the assets of Clouvou Inc. or any of its Corporate Affiliates (as defined below), or that portion of Clouvou Inc. or its Corporate Affiliates to which the Service relates, or in the event that we discontinue our business or file, or have filed against us, a petition in bankruptcy, reorganization, or a similar proceeding, provided that the third party agrees to adhere to the terms of this Privacy Policy.

Affiliates

We may disclose information (including personal information) about you to our Corporate Affiliates — including our parent company, Clouvou GmbH (Germany). For purposes of this Privacy Policy, “Corporate Affiliate” means any person or entity which directly or indirectly controls, is controlled by, or is under common control with Clouvou Inc., whether by ownership or otherwise. Any information we provide to our Corporate Affiliates will be treated by them in accordance with the terms of this Privacy Policy (or, where the affiliate serves EU/EEA customers directly, its own applicable privacy policy).

Governing Law

This Privacy Policy is governed by the laws of the State of New York and applicable U.S. federal law, without regard to conflict-of-laws principles, and applies solely to our United States store. You consent to the exclusive jurisdiction of the courts of the State of New York in connection with any action or dispute arising between the parties under or in connection with this Privacy Policy.

By using Clouvou or contacting us directly, you signify your acceptance of this Privacy Policy. If you do not agree to this Privacy Policy, you should not engage with our website or use our services. Continued use of the website, direct engagement with us, or following the posting of changes to this Privacy Policy that do not significantly affect the use or disclosure of your personal information, will mean that you accept those changes.

Your Consent

We've updated our Privacy Policy to provide you with complete transparency into what is collected when you visit our site and how it's used. By using Clouvou, registering an account, or making a purchase, you hereby consent to this Privacy Policy and agree to its terms.

Links to Other Websites

This Privacy Policy applies only to the Service. The Service may contain links to other websites not operated or controlled by Clouvou. We are not responsible for the content, accuracy, or opinions expressed on such websites, and they are not investigated, monitored, or checked for accuracy or completeness by us. Once you leave our Service to go to another website, our Privacy Policy is no longer in effect; your browsing and interaction on any other website is subject to that website's own rules and policies. Such third parties may use their own cookies or other methods to collect information about you.

Advertising

This website may contain third-party advertisements and links to third-party sites. Clouvou does not make any representation as to the accuracy or suitability of the information contained in those advertisements or sites, and does not accept responsibility or liability for the conduct, content, or offerings of those third parties. Advertising keeps Clouvou and many of the websites and services you use free of charge, and we work to make sure ads are safe, unobtrusive, and as relevant as possible.

Cookies for Advertising

These cookies collect information over time about your online activity on the website and other online services to make online advertisements more relevant and effective to you — known as interest-based advertising. They also perform functions like preventing the same ad from continuously reappearing and ensuring ads are properly displayed for advertisers.

Cookies

Clouvou uses “Cookies” to identify the areas of our website that you have visited. We use Cookies to enhance the performance and functionality of our website, but they are non-essential to its use. Without these cookies, certain functionality like videos may become unavailable, or you may be required to re-enter your login details each visit. Most web browsers can be set to disable cookies. However, if you disable cookies, you may not be able to access some functionality on our website correctly or at all. We never place Personally Identifiable Information in cookies.

Blocking and Disabling Cookies and Similar Technologies

Wherever you're located, you may set your browser to block cookies and similar technologies, but this may prevent our website from functioning properly and cause you to lose access to some features or saved information (e.g., saved login details, site preferences). Different browsers make different controls available; disabling a cookie or category of cookie does not delete it from your browser — you will need to do that yourself from your browser's settings.

Remarketing Services

We use remarketing services. In digital marketing, remarketing (or retargeting) is the practice of serving ads across the internet to people who have already visited your website. It allows our company to seem like it's “following” people around the internet by serving ads on the websites and platforms they use most.

Payment Details

In respect to any credit card or other payment-processing details you provide us, we commit that this information is handled in the most secure manner possible — in practice, it is processed and stored directly by our PCI-DSS-compliant payment processor(s), not by Clouvou.

Kids' Privacy

We do not address anyone under the age of 13. We do not knowingly collect personally identifiable information from anyone under 13, consistent with the Children's Online Privacy Protection Act (COPPA). If you are a parent or guardian aware that your child has provided us with Personal Data, please contact us. If we become aware that we have collected Personal Data from anyone under 13 without verification of parental consent, we take steps to remove that information from our servers.

Changes to Our Privacy Policy

We may change our Service and policies, and may need to make changes to this Privacy Policy so it accurately reflects our Service and policies. Unless otherwise required by law, we will notify you (for example, through our Service) before we make changes to this Privacy Policy and give you an opportunity to review them before they go into effect. If you continue to use the Service, you will be bound by the updated Privacy Policy.

Third-Party Services

We may display, include, or make available third-party content (including data, information, applications, and other products or services) or provide links to third-party websites or services (“Third-Party Services”). You acknowledge and agree that Clouvou is not responsible for any Third-Party Services, including their accuracy, completeness, timeliness, validity, legality, decency, or quality, and Clouvou does not assume any liability for them. Third-Party Services are provided solely as a convenience, and you access and use them entirely at your own risk and subject to their own terms and conditions.

Meta Pixel (Formerly “Facebook Pixel”)

The Meta Pixel — the same tool this Policy refers to elsewhere as the “Facebook Pixel”; Meta Platforms, Inc. renamed it after its 2021 rebrand from Facebook, but it is one and the same technology — is an analytics tool that lets us measure advertising effectiveness by understanding actions people take on our website. It may collect information from your device when you use the Service, held in accordance with Meta's own privacy policy.

Tracking Technologies

  • Cookies
We use cookies to enhance the performance and functionality of our platform, though they are non-essential to its use — see “Cookies” above for details.
  • Local Storage
Local Storage, sometimes known as DOM storage, provides web apps with methods and protocols for storing client-side data. It supports persistent data storage, similar to cookies, but with greater capacity and no information stored in the HTTP request header.
  • Sessions
We use “Sessions” to identify the areas of our platform that you have visited. A Session is a small piece of data stored on your computer or mobile device by your web browser.

Your US Privacy Rights

Your Privacy Choices / Do Not Sell or Share My Personal Information

Depending on your state of residence, you may have the right to opt out of the “sale” or “sharing” of your personal information, or its use for targeted advertising. You can opt out at any time here: https://us.clouvou.com/pages/data-sharing-opt-out.

Shopify also automatically honors the Global Privacy Control (GPC) browser signal for visitors from covered regions, opting them out without any manual click.

California Residents (CCPA/CPRA)

The California Consumer Privacy Act, as amended by the California Privacy Rights Act (CCPA/CPRA), requires us to disclose the categories of personal information we collect and how we use it, the categories of sources from which we collect it, and the third parties with whom we share it — all explained above. California residents have the right to: know and access the categories and specific pieces of personal information we collect, use, or share; correct inaccurate personal information; delete personal information we have collected (by submitting a verifiable request); limit our use of sensitive personal information; opt out of the “sale” or “sharing” of personal information, including for cross-context behavioral advertising; and not be discriminated against for exercising these rights, including a right to appeal a denied request.

California Online Privacy Protection Act (CalOPPA)

CalOPPA separately requires us to disclose categories of Personal Information we collect and how we use it, categories of sources, and third parties with whom we share it (explained above), and requires this Privacy Policy to state how we respond to Do Not Track signals: we currently do not respond differently based on a Do Not Track browser setting, but do honour the Global Privacy Control as described above.

Other US States

California is not the only state with a privacy law like this. Virginia, Colorado, Connecticut, Utah, Texas, Oregon, and a growing list of other states have each passed their own comprehensive privacy law, and each gives residents of that state similar rights: access, correction, deletion, and the right to opt out of the sale, sharing, or targeted-advertising use of their personal information, plus a right to appeal a denied request.

We extend the same opt-out mechanism to all US customers, not just California residents: the Shopify “Data sharing” opt-out setting above is configured to cover every US state, so the “Your Privacy Choices” link works the same way for any US visitor, whether or not their specific state's law currently requires it. This keeps the mechanism consistent and avoids having to add new state-specific plumbing each time a new state's law takes effect or Clouvou crosses a threshold.

If you make a request under any of the above, we have one month (or the period required by applicable state law, typically up to 45 days, extendable once) to respond. We do not sell the personal information of our users for money. To exercise any of these rights, contact us at support@clouvou.com.
